These terms govern your use of thexhotel.com thermal systems engineering services, fabrication contracts, and maintenance agreements for industrial heat exchange equipment. By accessing our platform, you accept these conditions in full.
Thexhotel.com provides engineering design, fabrication, and on-site maintenance of shell-and-tube heat exchangers, cooling towers, and pressure vessels for petrochemical processing. All work is performed per client specifications and applicable ASME, TEMA, and local safety codes. No implied warranties beyond those explicitly stated in the service agreement apply.
You must provide accurate process parameters—including fluid composition, operating pressure, temperature range, and flow rates—to enable correct thermal and mechanical design. Failure to disclose hazardous conditions or corrosive agents voids any performance guarantee. You are responsible for obtaining all necessary permits and ensuring site readiness before installation.
All engineering drawings, calculation sheets, fabrication procedures, and software tools developed by Thexhotel.com remain our intellectual property. You receive a non-transferable license to use the delivered design documentation solely for the operation and maintenance of the supplied equipment. Reverse engineering or reproduction of proprietary tube bundle geometries is prohibited.
Our liability for any claim arising from a service agreement is limited to the total fees paid for that specific project. We are not liable for consequential damages—including production downtime, fluid loss, environmental fines, or third-party claims—resulting from equipment failure, unless caused by gross negligence or willful misconduct on our part. This limitation survives termination of the agreement.
Fabricated equipment carries a 12-month warranty from the date of commissioning against material defects and workmanship errors under normal operating conditions as defined in the project specification. The warranty excludes damage from scale buildup, chemical attack, thermal shock, or operation beyond the agreed pressure-temperature envelope. Claims must be submitted in writing within 14 days of discovery.
Invoices are due within 30 calendar days of issue. Late payments accrue interest at 1.5% per month. If you cancel a fabrication order after material procurement has begun, you are liable for all incurred costs plus a 20% restocking fee. No refunds are provided for engineering hours already expended on design calculations or fluid dynamics modeling.
Either party may terminate a service agreement with 30 days written notice if the other party materially breaches its obligations and fails to cure within that period. Upon termination, you must return all proprietary documentation and pay for all work completed up to the effective date. Sections 3, 4, and 5 survive termination.
These terms are governed by the laws of India. Any dispute arising from the service agreement shall first be resolved through good-faith negotiation. If unresolved, the dispute will be settled by binding arbitration in Pune, Maharashtra, in accordance with the Arbitration and Conciliation Act, 1996. The prevailing party is entitled to reasonable legal fees.
We may update these terms at any time by posting the revised version on this page. Continued use of our services after the effective date constitutes acceptance of the changes. Material modifications will be communicated via email to the address you provided in your account. The current version is effective as of the date of publication.
